CHAPTER I
INTRODUCTION
A.Introduction
The issue of same-sex marriage is an argument that all of us
have heard, and most of us have strong opinions on. I know very
few people that don’t have a preference of legalization or not.
Personally, I believe that homosexuals should be granted the same
rights as heterosexual couples. Same-sex marriage, the practice
of marriage between two men or between two women. Although same-
sex marriage has been regulated through law, religion, and custom
in most countries of the world, the legal and social responses
have ranged from celebration.Same Sex marriage is an argument or
issue that all of us have heard. We all know that LGBT community
raised their rights to marry the person they want but Filipino
believed that marriage is a permanent union of a man and woman
only. Philippine is basically catholic country which holds a huge
influence in our society. However Dr. Martin Luther King Jr. Once
said that "marriage is a basic human rights. You cannot tell
people they cannot fall in love" it means he believes that there's
no race or gender in Love.
The issue of same sex marriage may seem cut and dry as an
individual decision, but when it comes to the legal issue,
the argument over same sex marriage is much more complicated.
1
Supporters of such marriages strongly believe that the right to
marry is a civil right, and it should not come with attached
restrictions based on gender. Though many states are now
recognizing same sex marriages, it is likely that the same sex
marriage debate will continue for some time. The strong
resistance of Christianity considering it as morally wrong. However
Allowing lesbian, gays, transgender, bisexual community to marry
the person they love here in the Philippines will strengthen
everyone rights. Homosexuals wanting to have their immoral
relationships sanctified by the government has meant that the word
“marriage” basically means nothing now, because it’s been watered
down so much.
The Bible says that there are specific roles for men to play
in a marriage and specific roles for women to play. Throwing those
roles out the window is equivalent to the moral breakdown of
society. The LGBT community remains as one of the country's
minority sectors today. Lesbian, gay, bisexual and transgender
people often face disadvantages in getting hired for jobs,
acquiring rights for civil marriage, and even in starting up
personal businesses. Most non-heterosexuals also have a higher
rate of suicide and suicide ideation compared to non-homosexuals.
According to an international research, 10% of the world's
population are theoretically part of the LGBT community, out or
not, including 12 million Filipinos that may experience
2
discrimination based on who they are. This has led to the rise of
the cause for LGBT rights, defined as the right to equality and
non-discrimination. Homosexual couples should have same rights
as heterosexual couples to marry who they love. In 2000 Netherlands
granted religious rites of marriage and legal recognition to
Lesbian, Gays, Transgender, bisexual, community. 20 other
countries including Belgium(2003). Canada(2005). Spain(2005).
South Africa(2006). Norway(2009). Sweden(2009). Argentina(2010).
Iceland(2010). Portugal(2010). Denmark(2012). Brazil(2013).
Englan and Wales(2013). France(2013). New Zealand(2013).
Uruguay(2013). Luxembourg(2014). Scotland(2014) and Finland(2015)
all of which have enshrined marriage equality in their laws.

CHAPTER II
REVIEW OF RELATED LITERATURE
Foreign
According to Gregory Lewis and Charles Gossett, though public
opposition to same-sex marriage seems reasonably stable
nationally, support in California has grown substantially in the
past two decades. Liberals, democrats, and the less religious are
the groups who are become much more supportive of same-sex
marriage.
According to Jean K. Quam and Gary S. Whitford, being active in
the gay community was an asset to accepting one’s own aging.
According to Laura R. Olson, Wendy Cadge, and James T. Harrison,
Religious variables play powerful roles in structuring attitudes
about same‐sex unions. Moreover, homosexuality appears to be a
major component of the “moral values” discourse that is currently
so popular in American politics.
According to Shekat, D., De Vries, M., Creek, S. Religious
factors are a source of racial differences in support for same‐sex
marriage, and secular influences play less of a role in structuring
African Americans' beliefs about same‐sex marriage.
According to Linda Silberman, The family–once upon a time the
corollary of marriage and the institution that constituted the
6
basis of civilized societies–has been shaken by the widespread
abandonment of fundamental traditional social understandings and
the failure of visible alternatives for ongoing social functions
and needs. Things are not what they used to be–even while popular
perception continues to wrap “marriage” and “family” in an
irrational, sentimental cocoon that has clouded logical discussion
and intelligent debate.
The arguments against same-sex marriage used by the Christian right and other social
conservatives in the US have shifted in character. Drawing upon the work of Stanley Kurtz, they
have increasingly suggested that same-sex marriage will necessarily lead to the legal
recognition of polygamous and polyamorous relationships. From this perspective, the Supreme
Court's ruling in had, by expanding notions of ‘sexual liberty’, paved the way for the legalisation
and recognition of all consenting adult relationships. The article suggests that the Christian
right's increased use of consequentialist arguments rather than claims structured around biblical
authority or opposition to homosexuality per se is a form of adaptation to long-term shifts in the
character of US popular attitudes.
LOCAL
According to Ryan Thoreson If the Supreme Court rules that the
provisions of the Family Code are unconstitutional and permits
same-sex marriage, or the national legislature enacts a law
allowing same-sex marriage, the Philippines will join Taiwan at
the forefront of Asian countries with marriage equality.
7
According to Lian Buan The fight for same-sex marriage in the
Philippines is still very much alive despite the recent Supreme
Court ruling that unanimously dismissed a petition based on
technical grounds – lack of a legal standing and violation of
hierarchy of courts.
"We just voted to dismiss the case because there is no case," Chief
Justice Lucas Bersamin told reporters on Wednesday, September 4,
saying that petitioner Jesus Falcis could not sue the Civil
Registrar General for denying marriage licenses to members of the
LGBTQ+ community if he himself had not applied for a marriage
license yet.
The lawyer insisted on a revisitation of Family Code's limit of marriages to heterosexual couples.
But through time, Congress resorted to another solution to address the issue since marriage,
according to the Constitution, is inviolable. It is also the main argument of those who oppose
the proposal. Bataan first District Representative Geraldine Roman, the country's first
transwoman legislator and a supporter of the same-sex civil union bill, has said that the only
difference between a civil union and marriage is that marriage has a "religious connotation".

CHAPTER V
SUMMARY, CONCLUSION AND RECOMMENDATION
A.Summary
Same-sex marriage is the marriage of two people of the same
gender or same sex. Same-sex marriage is already legal in some
country like Taiwan and United States. “ We are Catholics.”
President Rodrigo Duterte said during his campaign promise.
Because there’s a biblical says that man is only for woman and
vice versa.
Some of the responndents of the researchers says that if we
adapt the same-sex marriage in our country maybe we can have a
more case of rape. Because even man to man can have sex because it
is legal in country. And also woman can do the same.
B.CONCLUSION
The researchers conclude that if we adapt the same-sex marriage
in our country there’s a possibility that some of the groups of
people can experience discrimination. And the researchers conclude
that it can be also the reason to disrespect the religion of Roman
Catholics.
14
C.RECOMMENDATION
These from the result of the study, the following
recommendations were made:
a.) The researcher recommend that this study read by the
learners of San Jose City National High School – Senior

have respondents from different level of ages of LGBTQ may
be matured to answer or to understand the same-sex

In the end, marriage is a basic human rights. You cannot tell
people they cannot fall in love (Dr. Martin Luther King Jr.)
