RESOLUTION AUTHORIZING PUNONG BARANGAY RICHARD C. DIONEDA TO
PURCHASE LOT 3594-B1, Psd-05-006833 COVERED BY TCT NO.083-
2017000916 CONSISTING AN AREA OF 154 SQUARE-METERS OWNED BY
SPOUSES JERRY AND NYMIA GUASA LOCATED WITHIN THE TERRITORIAL
BOUNDARY OF BARANGAY ALMENDRAS-COGON, FOR TWO MILLION PESOS
Whereas, Section 19 of R.A.7160, the Local Government Code of 1991, authorizes local
government units, such as Barangay Almendras-Cogon to exercise the power of eminent
domain and to expropriate lands for public use or purpose.
Whereas, Barangay Almendras-Cogon is in need of a site for barangay hall which at
present, was newly constructed thru the program and auspices of the Department of Public
Works and Highways.
Whereas, the previous and the new barangay hall of Barangay Almendras-Cogon had
been constructed on the 154 square-meter parcel of land identified as Lot 3594 B-1 Psd-05-
006833 located within the territorial boundary of Almendras-Cogon, owned in fee simple by
spouses Jerry and Nymia Guasa.
Whereas, several negotiations had been made previously between the barangay
officials of Almendras-Cogon and Spouses Guasa as to the price of the above-described
property but negotiations failed.
Whereas, in the interest and welfare of the constituents of Barangay Almendras-
Cogon thru the exercise of the power of eminent domain vested unto local chief executives,
there is an urgent and imperative need to purchase the above-described property in order for
the barangay to acquire full ownership of it, for public use and purpose.
NOW THEREFORE, on motion of Kagawad Jocelyn S. Labitag, duly seconded by
Kagawad Ma. Luisa D. Sumallo, resolved as it is hereby resolved to authorize Punong
Barangay Richard C. Dioneda to purchase Lot 3594-B-1 consisting an area of 154 square-
meters situated within the territorial boundary of Almendras-Cogon for TWO MILLION
PESOS (Php 2,000,000.00) intended for public use and purpose.
