The amendment process highlights challenges in governance, such as the need for accurate demographic data to ensure fair representation. The reliance on available voter percentage data for implementing reservations, due to the absence of precise Census data, underscores the complexity of maintaining electoral fairness under limited data conditions .
The amendments specify that reservation of seats for women belonging to Scheduled Tribes, Scheduled Castes, or Backward Classes shall be made among the wards reserved for these categories where the percentage of women voters is the largest in descending order .
The reserved seats for Scheduled Tribes, Scheduled Castes, and Women are determined by referencing the largest percentage of voters from these categories to the total number of voters in each ward, arranged in descending order .
The use of descending order arrangement in the reservation process ensures that seats are reserved in wards where the representation of Scheduled Tribes, Scheduled Castes, and Women is maximized, thereby enhancing the impact and fairness of the reservation system by prioritizing wards with the most significant minority presence .
The amendments were prompted due to the lack of Enumeration Block wise and ward wise population figures available from the 2011 Census, which made it challenging to implement seat reservations effectively based on population data of Scheduled Tribes, Scheduled Castes, and Women. The Commissioner & Director of Municipal Administration proposed amendments on the same analogy as those made for the BC category since 2002, leading to changes in the rules .
The government consulted the Registrar General and Census Commissioner to obtain Enumeration Block level data for better implementation of the reservation rules. However, the outcome was that such detailed information was not available in the public domain, necessitating amendments to the existing reservation rules .
Rule 11 specifies that reservation for women, not belonging to Scheduled Tribes, Scheduled Castes, or Backward Classes, should be made from wards where there is the largest percentage of women voters, arranged in descending order. This ensures that women's reservation is also applied meaningfully across other demographics .
The amendments to the rules are made under section 585 read with sub-section (2) of section 5 of the Hyderabad Municipal Corporation Act, 1955, among other sections from corresponding legislative acts governing municipal corporations in Andhra Pradesh, which authorize the Governor to make such amendments .
The amendments prioritize wards with the largest percentage of Scheduled Tribes, Scheduled Castes, and Women voters, thereby enhancing representation where these groups are most numerous. This approach fosters inclusivity and attempts to balance governance by giving minority groups a stronger voice in wards where their presence is significant .
The government faced challenges because the 2011 Census did not provide Enumeration Block wise or detailed ward wise data, necessary for accurately determining reservations. This lack of detailed data required a change in the reservation approach, using available ward wise voter data instead .
