Right to Work Candidate Information Sheet

What is right to work?


All employers in the UK have a responsibility to prevent illegal working. Bakkavor is responsible for
checking an individual’s right to work in the UK by checking specific documentation before we can
employ them to ensure they are allowed to work in the UK and for any follow up checks where
required.

Who carries out the right to work checks?


Our local HR Teams carry out all prospective colleague’s right to work checks in the UK as part of our
recruitment and onboarding process to ensure that everyone we employ has the legal right to work.

New right to work rules since 1st July 2021.


Since 1st July 2021, new rules apply to employer right to work checks. New immigration requirements
mean EEA and Swiss citizens (and their family members) will be required to show they hold immigration
status to live and work in the UK, in the same way as other foreign nationals do.

What do the new rules mean for me?


If you are an EEA or Swiss citizen or a family member, you will no longer be able to rely on your EEA
passport or national identity card alone to prove your right to work in the UK and we will no longer be
able to accept the passports or ID cards of EU, EEA, or Swiss citizens as valid proof of right to work. If
you are an Irish national, your passport will continue to be acceptable proof of your right to work, and
the changes will not affect you.

How will my right to work now be checked?


EEA or EU citizens who were resident in the UK by 31 December 2020 are required to make
applications to the EU Settlement Scheme by 30 June 2021 and will be provided with digital evidence
of their UK immigration status. Once you have done this, you will then be able to evidence your right
to work by sharing your immigration status digitally, using the Home Office online right to work service
on GOV.UK.

Who can use the Home Office online right to work service?
If you have either a current Biometric Residence Permit or Card, or a status which has been issued
digitally under the EU Settlement Scheme under the Points Based Immigration System, or you have a
British National Overseas Visa (BNO), or you have a Frontiers Workers Permit, then the online service
is available to you.

How do I use the online service?


Bakkavor will be able to carry out an online right to work check for you if you have first viewed your
own Home Office right to work record using the GOV.UK service (link below).

Once you have done this, you will then need to generate and provide Bakkavor with a share code
which, when entered along with your date of birth, will allow Bakkavor to access the information via the
online service available on GOV.UK. The share code will be valid for 30 days from the point it is issued
and then a new code will be required.

What if I do not have digital immigration status?


If you are unable to demonstrate your right to work digitally, Bakkavor would need to carry out a manual
document based right to work check for you. This would be done by us checking your documents from
the updated Home Office manual right to work checklists which for ease, we have provided in this

information sheet. In some circumstances we may need to contact the Home Office’s Employer
Checking Service to obtain a Positive Verification Notice from them to confirm you are allowed to
carry out the work in question.

Manual right to work checklist


If you are unable to demonstrate your right to work digitally, Bakkavor would need to carry out a manual
document based right to work check for you by checking your original documents from the three right
to work checklist tables below.

Please note the following


• All documents needed for manual right to work checks must be originals, in many cases they
also need to be current, and, in some cases, more than one type of document may need to be
provided.
• You will not be able to start working for us until we have been able to carry out the right to work
checks. Any delays with you being able to provide us with the necessary documents for these
checks, could mean a delay to your start date.
• When List A documents are provided to us, there is no need to carry out any repeat right to
work checks as the initial check applies for the duration of your employment with us.
• When List B Group 1 documents are provided, the right to work will expire when the person’s
permission to be in the UK expires. This means we would then need to carry out a follow up
check when the documents evidencing the current permissions to work expires
• When List B Group 2 documents are provided, the right to work will expire 6 months from the
date specified in the Positive Verification Notice. This means we would need to carry out a
follow up right to work check when the Positive Verification Notice expires.

List A documents that are acceptable on their own for manual right to work
checks from 1st July 2021
1. A passport (current or expired) showing that the holder, or a person named in the passport as
the child of the holder, is a British citizen or a citizen of the UK and Colonies having the right to
abode in the UK
2. A passport or passport card (current or expired) showing that the holder is a national of the
Republic of Ireland
3. A current document issued by the Home Office to a family member of an EEA or Swiss citizen,
and which indicates the holder is permitted to stay in the UK indefinitely.
4. A document issued by the Bailiwick of Jersey, the Bailiwick of Guernsey or the Isle of Man, which
has been verified as valid by the Home Officer Employer Checking Service, showing that the holder
has been granted unlimited leave to enter or remain under Appendix EU to the Jersey Immigration
Rules, Appendix EU to the Immigration (Bailiwick of Guernsey) Rules 2008 or Appendix EU to the
Isle of Man Immigration Rules
5. A current biometric immigration document (Biometric Residence Permit) issued by the home
Office indicating that the holder is allowed to stay in the UK indefinitely or has no time limit on their
stay in the UK
6. A current passport endorsed to show that the holder is exempt from immigration control, is allowed
to stay indefinitely in the UK, has the right of abode in the UK, or has no time limit on their stay in
the UK
7. A current Immigration Status Document issued by the Home Office to the holder with an
endorsement indicating that the named person is allowed to stay indefinitely in the UK or has no
time limit on their stay in the UK, together with an official document giving the person’s permanent
National Insurance number and their name issued by a government agency or a previous
employer.
8. A birth or adoption certificate issued in the UK, together with an official document giving the
person’s permanent National Insurance number and their name issued by a government agency
or a previous employer
9. A birth or adoption certificate issued in the Channel Islands, the Isle of Man or Ireland, together
with an official document giving the person’s permanent National Insurance number and their
name issued by a government agency or a previous employer

10. A certificate of registration or naturalisation as a British citizen, together with an official document
giving the person’s permanent National Insurance number and their name issued by a government
agency or a previous employer

Manual right to work checklist

List B Group 1 documents that are acceptable for a time limited period (until
the expiry date of leave) for manual right to work checks from 1st July 2021
1. A current passport endorsed to show the holder is allowed to stay in the UK and is currently allowed
to do the work in questions
2. A current biometric immigration document (Biometric Residence Permit) issued by the home Office
indicating that the holder is currently allowed to stay in the UK and is allowed to do the work in question
3. A current document issued by the Home Office to a family member of an EEA or Swiss citizen, and
which indicates the holder is permitted to stay in the UK for a time limited period and to do the work in
question.
4. A document issued by the Bailiwick of Jersey, the Bailiwick of Guernsey or the Isle of Man, which has
been verified as valid by the Home Officer Employer Checking Service, showing that the holder has
been granted limited leave to enter or remain under Appendix EU to the Jersey Immigration Rules or
Appendix EU to the Immigration (Bailiwick of Guernsey) Rules 2008, or Appendix EU to the Isle of Man
Immigration Rules.
5. A document issued by the Bailiwick of Jersey, the Bailiwick of Guernsey which has been verified as
valid by the Home Officer Employer Checking Service, showing that the holder has made an application
for leave to enter or remain under Appendix EU to the Jersey Immigration Rules or Appendix EU to the
Immigration (Bailiwick of Guernsey) Rules 2008 on or before 30 June 2021
6. A frontier worker permit issued under regulation 8 of the Citizens’ Rights (Frontier Workers) (EU Exit)
Regulations 2020
7. A current Immigration Status Document containing a photograph issued by the Home Office to the
holder with a valid endorsement indicating that the names person may stay in the UK and is allowed to
do the type of work in question together with an official document giving the person’s permanent
National Insurance number and their name issued by a government agency or a previous employer.

List B Group 2 documents that are acceptable for a time limited 6-month
period for right to work checks from 1st July 2021
1. A document issued by the Home Office showing that the holder has made an application for leave to
enter or remain under Appendix EU to the immigration rules (known as the EU Settlement Scheme) on or
before 30 June 2021 together with a Positive Verification Notice from the Home Office Employer
Checking Service
2. A document issued by the Bailiwick of Jersey, or the Bailiwick of Guernsey showing that the holder has
made an application for leave to enter or remain under Appendix EU to the Jersey Immigration Rules
or Appendix EU to the Immigration (Bailiwick of Guernsey) Rules 2008, or Appendix EU to the Isle of Man
Immigration Rules, together with a Positive Verification Notice from the Home Office Employer
Checking Service
3. An Application Registration Card issued by the Home Office stating that the holder is permitted to take
the employment in question, together with a Positive Verification Notice from the Home Office
Employer Checking Service
4. A Positive Verification Notice issued by the Home Office Employer Checking Service to the employer
or prospective employer, which indicates that the named person may stay in the UK and is permitted
to do the work in question.
5. A Certificate of Application (digital or non-digital) issued by the Home Office showing that the holder
has made an application for leave to enter or remain under Appendix EU to the immigration rules
(known as the EU Settlement Scheme), on or after 1 July 2021, together with a Positive Verification
Notice issued by the Home Office Employer Checking Service.

Online right to work check example
1. Individual registers on the online system https://www.gov.uk/prove-right-to-work

2. Individual provides the share code.

3. With the share code and the individual’s date of birth, Bakkavor can then carry out an online right
to work check for the individual to confirm their right to work status or any restrictions that may
apply. This check would need to be made in the presence of the individual either in person or via
live video link.
