Your Affiant was assigned to investigate the facts and circumstances surrounding Miami-Dade Police Department (MDPD) case number: PD190310087486. As a result of that investigation, Your Affiant has determined the following to be true based on information and belief and does believe that he has probable cause to arrest the following persons: Aimee Marie Martinez a white female with the Date of Birth of: 08/26/1987, § Florida Driver License Number: CIN Number: 0813956, for one (1) count of Second-Degree Murder with a deadly weapon, in violation of Florida State Statute § 782.04(2), a Life Felony. AKEFIANTS’ BACKGROUND INFORMATION, “Your Affiant,” Detective Michael Brajdic, Badge #4788, of the Miami-Dade Police Department (MDPD), Criminal Investigations Division, Homicide Bureau, has been a Police Officer for approximately 23 years and has been assigned to the MDPD Homicide Bureau since January 25, 2010. During “Your Affiant’s” tenure in the Homicide Bureau, “Your Affiant” has investigated numerous homicides, death investigations, as well as police-involved shooting investigations. “Your Affiant” is also responsible for training newly assigned investigators to the Homicide Bureau. “Your Affiant” was assigned as the lead investigator into a homicide which was documented under MDPD case number: PD190310087486, AFFIANT @9 ASA KR JUDGE _/) ) Page 1 of7 AW AIMEE MARTINEZ ~ PD1903 10087486‘This affidavit is based upon information known personally to “Your Affiant” based upon investigation, and information obtained from others who have investigated this matter and/or have personal knowledge of the facts herein have determined the following to be true. Because this affidavit is being submitted for a limited purpose of establishing probable cause, “Your Affiant” has not included every aspect, fact, or detail of this investigation. AC’ IN SUPPORT OF PROBABLE CA\ “Your Affiant” was assigned the investigation into the homicide of Osmanny Montano, W/M/34, DOB: 04/16/1984, hereinafter referred to as “The Victim,” which was documented under MDPD Case Number: PD190310087486. During the investigation, “Your Affiant” has learned the following On Sunday, March 10, 2019, at 7:36 a.m., units from the Miami-Dade Police Department (MDPD) Kendall District, were dispatched QT. in reference ta report of a female who shot her husband. ‘The reporter, Aimee Martinez, W/F/31, DOB: 08/26/1987, hereinafter referred to as “The Subject,” who utilized cellular phone number (305) 985-9559, advised the 911 operator that she shot her husband during the course of a conftontation. ‘The reporter advised her husband “attacked her” and she “shot him.” She advised her husband got up after he was shot and came at her again, at which time she shot him a second time, The reporter advised the 911 operator that her husband was “shot in the neck and under the ribs,” and that her husband was located “on the stairs.” The reporter exited the residence and was met by units from the MDPD. Upon the arrival of emergency units, “The Victim” was discovered lying on the residence stairwell, having sustained apparent gunshot wounds of the chest and neck. “The Victim” was determined deceased on scene by Miami-Dade Fire Rescue (MDFR) at 8:00 am, “The Subject,” was detained in the rear of'a marked police vehicle atthe scene. “The Subject” ‘was evaluated by MDFR and no visible injuries were observed. “The Subject” advised police units ” “The Subject” advised the the firearm utilized during the homicide was located “on top of the stai AFFIANT fo) asa KR Page 2 of 7 AW AIMEE MARTINEZ ~ PD190310087486firearm was owned by her and identified herself. as Aimee Martinez and her husband as “The Victim.” “The Subject’s” son, M W/M/2, DOB: vas later learned to be present in the same room at the time in which the homicide occurred. ‘When asked by uniform units on scene what transpired, “The Subject” advised she shot “The Victim” during a verbal altercation, “The Subject” stated both she and “The Victim” were sleeping in different rooms because he was having a post-traumatic stress disorder episode because he was a United States Army veteran, ‘The Subject” was subsequently transported to the MDPD Homicide Bureau office where she was read Miranda per form, waived her right to counsel and provided the following statement: “The Subject” advised that prior to the homicide, “The Victim” went upstairs and started to scream at her at which point they both went downstairs, and he began hitting himself and threw keys at her. “The Subject” stated she then returned upstairs to the bedroom and retrieved a firearm fiom a clothes basket next to her bed. “The Subject” stated she retrieved the firearm and concealed it under her buttocks. According to the “The Subject, “The Victim” re-entered the bedroom and noticed “The Subject” was concealing something under her body. “Ihe Subject” claimed that “The Victim” reliazed the item was firearm and tried to retrieve it. During this tussle “The Subject” explained that she shot “The Victim” was he was on top of her and that his body was no more than one to two fect from her. After the first shot, according to “The Subject”, “The Victim” reacted and she shot him a second time. “The Subject” acknowledged that although “ he had never really hit her before. e Vietim” was “aggressive and scary” “Your Affiant” proceeded to document the scene of the homicide while “The Subject” was interviewed at the MDPD Homicide Bureau. The firearm utilized during the course of the homicide was located at the top of the residence stairwell on a white box. The firearm was identified as a Smith and Wesson M&P 40 caliber, bearing Serial Number: HSC2862. The firearm ‘was observed to have a magazine inserted in it and the slide was in the forward position. The magazine capacity was 10 rounds and there were 5 cartridges loaded in the magazine and a cartridge loaded ia the chamber, FFIANT asa KR JUDGE Page 3 of 7 AW AIMEE MARTINEZ ~ PD190310087486‘The shirtless body of “The Victim” was observed lying supine in the stairwell leading to the second floor. There was blood observed on “The Victim’s” arms, legs, feet, torso, and face. “The Victim” was clad in a pair of dark color shorts and he was not wearing a shirt. “The Victim” had visible gunshot wounds of the left chest and left neck. Arterial spurting is observed on the bedroom wall as well as the staircase walls leading to where to where “The Victim” was found. Upon entering the northeast bedroom where the shooting occurred, the bedroom door was observed to be fully opened inward into the room, All artical spurting, pooling of blood, and blood transfer was concentrated at the foot of the bed. A white pillow was observed on the bedroom floor in between the left portion of the bed and an open closet. The pillow was near other miscellaneous items to include a blue plastic hamper where “The Subject” advised she retrieved the firearm, No defects were observed to the pillow at first observation, but open unfolding the pillow, burning and soot is observed in the center portion of the pillow along with a projectile hole. Upon turning the pillow over, a hole is observed on the opposite side. There was no observable blood on the pillow A black firearm holster was found concealed by a folded back fitted sheet on the mattress at the top/left portion of the bed, near the headboard. Two casings were located in the bedroom. ‘The first casing was recovered on the top left portion of the bed, near the headboard. The second casing was found inside of the bedroom closet directly accross from the left side of the bed. A projectile strike mark was observed in the closet door and a projectile was recovered from inside of it. The pillow was found on the ground next to the foot of the closet door. There was no blood pooling or blood spatter, located in the area of the pillow, wall, closet door, or area of the bed in which “The Subject” claimed to be seated at the time in which “The Victim” was shot. There were no other casings or firearms found in the residence or any other indication of shots fired in the residence, On Monday, March 11, 2019, an autopsy of “The Victim” was performed by Miami-Dade County Medical Examiner Department, Chief Medical Examiner, Dr. Kenneth Hutchins under ¢ al AEFIANT, asa KR VW? Page 4 of 7 AW AIMEE MARTINEZ ~ PD190310087486Medical Exai r Case Number: 2019-00802. At the conclusion of the autopsy, Dr. Hutchins determined the cause of “The Vietim’s” death was two gunshot wounds. One gunshot wound entered the left chest, perferates and lacerates “The Victim’s” heart and exited through the left side of his back. The other gunshot wound entered the left side of “The Victim’s” neck lacerated the left subclavian artery and vein traveled downward perferating the left lung and finally lodging itselg in the soft tissue of the left side of the back, Dr. Hutchins determined there was no stippling or soot on the vietim’s body. Stippling is the buming of either clothing or skin by the gunpowder which fires out of the firearm along with the bullet, Soot is gunshot residue that is left behind by the buming of the aecelertant used to propel the projectile from the cartridge. Soot occurs when the shot is made at point blank range. The distance when stippling will appear depends on the actual firearm and ammunition used but in general will appear if the end of the barrel of the firearm is within 24 inches or less from the skin or clothing. Dr. Hutchins, of the Miami-Dade County Medical Examiner Department, advised that a gunshot wound of the chest, like which “The Victim” sustained, would cause internal bleeding and cause the chest cavity to fill with blood as opposed to a gunshot wound to the neck, especially striking an artery, which would cause spurting and considerable external blood loss. It was later learned that a pint of blood was removed from the chest cavity of the victim during the course of the autopsy. On Wednesday, April 5, 2023 testing was performed by Firearms analyst John Mancini, of the MDPD Forensic Services Bureau, in which the firearm used during the course of “The Victim’s” homicide was discharged into several pillows in an attempt to recreate the condition of the original pillow from the homicide scene. At the conclusion, it was determined that the burn pattems created by the testing were consistent with those on the pillow found on the scene of the homicide having been folded over the firearm at the time of discharge. “Your Affiant” then responded to the MDPD Homicide Bureau office in reference to conducting a seggndary interview of “The subi ye order to question her pertaining to the AFFIANT ASA JUDGE 2 Page 5 of 7 AW AIMEE MARTINEZ ~ PD190310087486presence of the projectile hole in the pillow. “The Subject” reiterated her previous statement and denied shooting through any pillow during the homicide of “The Vietim.” “The Subject” was asked if anyone at the residence shot into a pillow at any point prior to the homicide incident, to which she advised that no one shot into a pillow. “The Subject’s” statement, in which she claims she shot “The Victim” while he was on top of her attempting to gain control of her firearm is completely refuted by the physical evidence. Including but not limited to the testimony of Dr. Hutchins regarding the trajectories of the gunshots, the lack of stippling or soot surrounding the gunshot wounds on the, the location of the blood evidence in relation to the projectile strike on the closet door, and the evidence that one of the shots was fired from the firearm while it was concealed inside of a folded pillow. ‘or all of the above-stated reasons, there is probable cause to believe that the “The Subject” committed first-degree murder of “The Victim” on Sunday, March 10, 2019, at 7:36 a.m. WHEREFORE, “Your Affiant” prays that an Arrest Warrant be issued commanding the Director of the Miami-Dade Police Department, who is also known as the Sheriff of Miami-Dade County, Florida, or his Deputies, and the Commissioner of the Florida Department of Law Enforcement, or any of his duly constituted agents, and all investigators of the State Attorney of the Eleventh Judicial Circuit of Florida, Miami-Dade County, Florida, with the proper and necessary assistance, to arrest: Aimee Marie Martinez.a white female with the Date of Birth of: 08/26/1987, SSN Florida Driver License Number: CIN number: 0813956, for one (1) count of First-Degree Murder with a deadly weapon, in violation of Florida State Statute § 782.04(1), a Capital Felony punishable by death or life imprisonment, AFFIANT © asa KR sUDGE (AZ Page 6 of 7 AW AIMEE MARTINEZ ~ PD190310087486OATH 1 SWEAR, under penalty of perjury, that the above information is true and correct.
