Contractor shall have no claims arising out of such extension of time. In the
event, if there is any dispute on the reasons for the delay or on whose account the
delay is attributable, Head Engineering of Employer shall be final adjudicating
authority.
24. PROCUREMENT PLAN: - Material procured by contractor with basic price
Material procurement plan shall be submitted before procuring the materials and
shall be duly approved by Engineer in Charge. Any delay in procurement or cost
escalation due to Contractor#s failure to procure on time shall be Contractor#s
responsibility.
The basic rates shall be reckoned for the purposes of price variation only.
Contractor shall get such necessary approval of material price and brand of
material before procurement of materials from Employer and price to be valid for
the period as agreed at the time of approval. All such agreed variations
(upwards/downwards) will be to Employer#s account and no other charges will be paid
towards overheads & profits and other expenses. The variation will be paid towards
measured quantities subject to allowed wastages mentioned in Appendix Kl.
25. PLANT & MACHINERY: (if applicable)
Contractor shall mobilize the equipment#s as per submittal in the tender document.
However, Contractor has to ensure progress of works and shall deploy additional
Plant & machinery to meet the project schedule as directed by Engineer In charge at
no extra cost to Employer. For all plant & machinery safe installation, periodical
checks, calibration etc. are mandatory and records of the same shall be submitted
to Employer representative.
26. CO-ORDINATION WITH SUB-CONTRACTORS DIRECETLY APPOINTED BY EMPLOYER FOR OTHER
WORKS: (if applicable)
Employer shall not pay any additional charges towards co-ordination with directly
appointed sub-Contractors by Employer. Main Contractor has agreed to share and
facilitate available infrastructure to other sub-Contractors on chargeable basis
and cost towards same shall be paid directly to Main Contractor by sub-Contractors.
The charges towards the same shall be fixed in coordination with Employer.
27. LABOUR POLICY:
Contractor will have to comply with the provisions of the Contract Labour
(Regulation and Abolition) Act 1970, Minimum Wages Act 1948, Payment of Wages Act
1936 and any amendments thereof and all legislations and rules of the State and /
or Central Government or other local authority, framed from time to time, governing
the protection of health, sanitary arrangements, wages, welfare, safety for labour
employed on building & construction works, bonus, retirement benefits,
retrenchment, lay off, compensation and all other matters involving liabilities of
employees. The rules and other statutory obligations with regards to fair wages,
welfare and safety measures, maintenance of register, etc. is deemed to be part of
the contract.
Contractor shall submit EPFO registered certificate copy upon acceptance of work
Order at project site before starting of works. Payments made shall be verified
directly from the EPFO portal or on a payment receipt obtained by the Contractor,
randomly from the EPFO portal before making payment as per the EPF & MP act 1952
No. CAIU/ 011(33)2015/ HQ/Vol II dated 02-02-2017. In case of non-payment of PF
amount, same shall be deducted from the RA Bills. All the Contractors shall comply
EPFO norms. All the Payments due to the Contractor shall be made only after
verifying that the statutory PF payments have been made to EPFO.
Contractor has to comply with latest ESIC regulations & shall provide evidence with
each RA bill.
Contractor will also furnish a copy of Workmen Compensation Policy taken by
Contractor. Contractor shall fulfil the Child Labour (Prohibition & Regulation)
Act-1986, 1988 & 1998 and amendment thereon if any. Contractor shall comply with
the Inter-state Migrant workmen (Regulation of employment & conditions of service)
Act 1979 and amendment thereon if any.
Contractor shall comply with National safety code and Building and Other
Construction Workers Act 1996 (BOCW) and comply with all applicable safety
regulations. However, Contractor shall compulsorily enrol Contractor workers
working on project site under social welfare scheme and provide Employer with a
copy of such enrolment. The details of benefits available to the workers under the
above scheme can be obtained from Employer#s administration department.
