to issue laws that implement international and

6. " 2. Definition
? A9% "k! UR$( g In this Proclamation, unless the context
<@" Z A+, (<.- requires otherwise:
1/ “9$" :; !9%” 'W 9$" :; 3/ “Rural Land Registration” means the
:$@! :> %W^_` U9W process of recording and organizing land
:OP 'R%RI '$>@"> j` information pertaining to rural
U Ok (i landholding and land use rights';
4/ “9$" :; A<= "” 'W 9$" 4/ “Rural Land Administration” means a
:; ^_` : UR.I +<> process whereby rural land holding rights
UO9.I :; x + are recognized and recorded, tenure
U:EI :; A$?@! Ej[ security ensured, land property valued, a
U9" :; $?Uw :J land use plan is prepared and
implemented, land dispute among land

JU W( W :; A$?@! degradation and environmental pollution
A' :J :; :E> are determined and implemented from
among the different use options a rural

: ~ ^! U := ( EE< livelihood depends on livestock

7/ “JK A"L A "” 'W Z A+, 10/ “Semi-pastoralist" means a person, whose
:O : ~ ^! U := ( livelihood depends on livestock

A"L A N ^! JK A"L A N land that farmers, pastoralists, and semi-

74/ “:EF< ^_`” 'W ^! F 14/ “State Landholding” means land which is
^_` d :; gE :EF< not held as communal or private and
' ^_`w EI E :;L EI ¤" includes land holdings of government
EE<> .j `w EI x^ EI organs, forest lands, wildlife, and
E_ E> E :^ :q protected areas, lakes, rivers, and other
E $? i similar holdings;
7C/ “9 . :; ^_`” 'W 15/ "Illegal Landholding" means any rural
%g :E9[ d> AF% %W( A landholding held illegally and not
E(j> R$( '>o(! 9$" recognized by the appropriate body;

:; o( Rw :<$ (i this Proclamation or other regional laws,
or land that was voluntarily relinquished
by previous holders to those who are
landless or with small holding size;
36/ “¢F¢F” 'W 9$" :; n© 22/ “Re-distribution” means the transfer of

%W^_` ^_`(E R( where a landholder agrees, for a period
URE f EE W'( E> J] of time to be determined by regions, with
U9h(E !" U<'£ :$E another person to use his landholding in
exchange for a share of the crop;

3C/ “± ²OX :a .” 'W 25/ “National Geodetic Reference Point"
A9" A@n OP <E R$( A means a point established by a nationally
:O ± ²OX ![" authorized organ; a part of the national
:$ . :O A g> geodetic control points network which

(i surveying activity;

9 :EF< AE@ under Article 47 of the Constitution of

Administration;
3/ “Uµ<¶"” 'W F"> Uµ<¶" (i 27/ “Ministry” means the Ministry of
Agriculture;
3/ “R(” 'W e.N R( ^! F 28/ “Person” means any natural or juridical

3D/ Z A+, 'E~(! E[ ·` 29/ In this Proclamation, any expression in
9Wp( ·`E! ` the masculine gender shall include the
feminine.
1. A+¬ e¸U RE 3. Scope of Application
// ^Z A+, I (<. U9{ 1/ This Proclamation shall apply to any rural
'E~(! 9$" :; E> J' land in Ethiopia and certain rural kebeles
(<. E> J' in the Regions and City Administrations
A<= N (<. RM 9$" in urban areas.

6/ Z AE@ EU< AE@ (/) 99( 2/ Without prejudice to Sub-Article (1) of
EE $@ gT Z A+, [Eºw this Article, this Proclamation shall apply
J' RE (<. $?W 9" FE to lands that are incorporated into urban
" % O9%o( ^_`w ^! boundaries but where such lands have
e¸U ^TO+ not yet been officially handed over to the
urban administration.

9$" :; <W'Fh> <W:$@! ACCESS AND USE OF RURAL LAND

C/ Z AE@ EU< AE@ (6) 99( 5/ Notwithstanding Sub-Article (2) of this
T"! 7 A: o( ®\o(E Article, orphans who are below 18 years
ª Z¯>I ®\o( 9$" ^TH of age whose parents used to live in rural
H> o( :; o( Jg areas and did not have their own land
9$" :; 'Fh : A o( holdings shall have the right to get rural
land.
8/ =" ^ w AE¤ F! g 6/ Where one of the spouses does not have
^_` JW( EE 'E~(! :; joint or private holding, he shall have the
A% A: :; 'Fh : right to access land, like any landless
AW( UR$( :;! F ^_`( person. The land granted shall be
gT ^:d9% registered as a private holding of such a
person.
/ :; ^_`( ]WQ! w F 7/ Where the landholding is acquired during
^_` ^T o( 9h Jg ]WQ! their marriage and both spouses do not
^_` gT ^:d9% have private holding, it will be registered
as common property of both spouses.
C. :EF<` gM [",L I 'Z ' 5. The Right of Non-Governmental
E> F %Wx 9$" :; 'Fh Organizations, Social Institutions and
: Private Investors to Access Rural Land

4/ Z AE@ EU< AE@ (/) $@y 4/ Social institutions referred to under Sub-
'Z ' ^_`o(E J'(O< E> Article (1) of this Article shall have all
<¡` J'< Wn (z W%W^_`w holding rights other than bequeathing
Rª :L ] ^T o+ and gifting.
C/ 9$" ' WUR'H F %WxL 5/ Private investors who intend to engage in
> IE¾<:E rural development shall have the right to
e¸U ^g> access rural land as per regional
investment laws and policies.
8. 9$" :; :$@! : pEL 6. Duration of the Right to Use Rural Land

9$" :; ^_` c^L E> %W^_`w THE HOLDING TYPES OF RURAL LAND
:;`o( ^ <WUT o( : AND THE RIGHTS OF HOLDERS ON
THEIR LAND
. ^_` c^L 7. Holding Types
9$" :; ^ ^_` c^L FI Rural land holding types include private,
E> :EF< >o( communal, and state holdings.

^ by regional laws.
6/ Z AE@ EU< AE@ (/) 99( 2/ Without prejudice to Sub-Article (1) of
EE $@ gT ¼ ^ d:M Wc:` this Article, the lease period may not be
R J 7 c: EE ]! WU J more than 10 years for annual crops and
¿ c: . A^ ! 30 years for perennial crops.
1/ Z AE@ EU< AE@ (/) 99( 3/ Without prejudice to Sub-Article (1) of
EE $@ gT Aj: I this Article, the elderly, female-headed
E' w I Z¯>I EE ]! W households, children, and other people
!E ^_`o(E W'' \ who cannot cultivate their land for valid
%W^_`w ^_`o(E ££ reasons may not be restricted from
J'J A^JWJ! leasing out the whole of their
landholding.
4/ ¼ ^ ( B]n : OF> 4/ Lease contracts shall be authenticated and
<E R$( ! :O9.> registered before an institution
::9 AW%o( authorized by regional governments.
7. :; '< WnE :WJQ :OPw E 10. Organizing And Providing Information
<W' r> <W:<$ Related to Land Transfers
// 9$" :; A<= " ' 1/ Regional Rural Land Administration
I _E I O= I J' I O=> Institutions shall establish working teams
@ B/#`o( q AJ > in their Regional, Zone, Special Woreda,
J EI ^_`o(E :W+. Uek City, Woreda, and Kebele offices that
%W^_`w E EE ]! ^_`o(E may gather and provide information
J%Wx " '' UekE about potential lessors and lessees,
landholders who intend to exchange their
%W^_`w E:d9 U9>{ E>
holdings as well as jointly develop their
A%(E :; 9 E$> :OP holdings with investors. Such working
UR. n -' teams shall conduct assessments on the
local land market, and avail information
to interested parties.
6/ n A OPr> AR " b"c 2/ The Organization and workflow of the
Uª ^R> team shall be determined by regional
laws.

7/. <¡` 11. Donation
6/ Z AE@ EU< AE@ (/) 99( 2/ Without prejudice to the provisions of
EE $@ gT %W^_`( ( Sub-Article (1) of this Article, the
9e ^¡O~ <!! ( landholder may transfer his holding
W9%W W'E~(! R( <¡` through gift to any person through
'< Wn ^ maintenance contractual agreement.

6/ 9$" :; :$@! :E :$@! 2/ Financial institutions shall consider the
A=w URª [" :$E maximum potential of the land when
=(E EjÁ U providing credit to the landholder.

1/ 9$" :; %W^_` :$@! :QE 3/ A landholder may collateralize his use
R( J«^>E< ' WU O( right as suretyship.

4/ A=> = [" ::Wa fE> 4/ Contracting parties shall stipulate under
[H £ ^! JK %^:W< their contract the time for the repayment
A= :;QE ^ U E f of the debt, and the length of time that
9 F ( o( ^ '<@:. the creditor may use the land where the
AW%o( debtor fails to pay the whole or part of
the debt.
C/ [H %W::Wy !E A=( 5/ The land use right of the creditor over the
+<> d(E :; :$@! : collateralized land shall not exceed

8/ = ( o( $@R( f [HE 6/ Where the debtor fails to pay the debt at

time only.

6/ ^_`o(E q` 9$! WU"y 2/ Regional laws shall provide incentives to
%W^_`w W 'O`\w E landholders who are cultivating their
'jO AW%o( land through cluster.
1/ ^_`o(E q` 9$! WU"y 3/ Regions shall create market linkage to
%W^_`w W!"L\o( 9 <<" landholders who are cultivating their
:n$" AW%o( land through cluster.
:EF< ^! :EF<` %gM [",L Landholders whose holdings are within
ÇNrL 9s :<T A(`N $?U government or non-governmental
gM :; %W^_`w ^_`o(E q`9$! organizations’ irrigation projects shall be
'[OF E> q` 9$! 'O< AW%o( bound by consolidation and clustering
schemes laid by the government.
