of the Land namely Property Card duly maintained
at Vice Superintendent of land Records, Pen As per
the Property card the above-mentioned land stands
in the name of the owner and occupant has been
shown as by Suresh Chandmal Jain for 25.06 [Link]
Area, Krushna Rambhau Ramdharne for Gala
admeasuring 16.22 [Link] area ,Savita Tukaram
Shirsagar for First Floor Gala admeasuring 486 [Link]
area, Rajeshkumar Madhubai Patel for 34.80 [Link]
Area and remaining area of the said owned by Mojes
Abraham Penkar and Sofi Mojes Penkar.
All that land, piece and parcel of the above land
is situated in the local limits of Pen Municipal Council,

Tal: -Pen, Dist.-Raigad. The above-mentioned land is
Non-Agriculture Land.
The above-named owner furnished for my
perusal following documents for purpose of
ascertaining (Marketable Title) of the said Property.

Devolution of the Title as per Documents &

 As per possession and application dated 12/10/1946


it reflects that, Abraham Harkol Penkar is Owner of
the said land.

 As Per [Link]. 779 it reflects that, Mortgage Deed of


Rs 2000/- executed in favor of Pen [Link] Bank
Ltd on 28/06/1947.

 As Per [Link]. 440 it reflects that, Mortgage Deed of


Rs 2000/- executed in favor of Pen [Link] Bank
Ltd on 28/06/1947.

 As per mutation entry dated 19/0/1955 it reflects


that, On 19/05/1955 as per recovery certificate in
favor of the Pen [Link] Bank Ltd. As per said
recovery certificate the possession of the said land is
obtain by Pen [Link] Bank Ltd

 As per mutation dated 16/12/1964 it reflects that,


Abraham Harkel Penkar died on 14/03/19963 his

legal heirs Searabai Abraham Penkar name recorded
as Karta of family.

 As per mutation entry dated 06/06/1966 it reflects


that, Pen [Link] Bank Ltd issue later that the
loan obtain by owner is fully paid with interest
therefore the charge in the name of Pen
[Link] removed from the Property Card of
the said land and the possession of the said land
handover to the owner.

 As per Mutation entry dated 15 December 1968 it


reflects that to give effect to the entry in Property
Card of the said land as per Bombay Weights and
Measures (Enforcement) Act, 1958 & Indian Coinage
Act 1955 the implementation of Decimal Method
recorded in the revenue record of the above-
mentioned land.

 As per Mutation entry dated 10/04/1981 it reflects


that, Shrimati Revatibai Baliram Gauri purchased 45

registered sale deed dated 10/04/1980.

 As per Mutation entry dated 18/12/1989 it reflects


that, Suresh Chandmal Jain purchased 25.04 [Link]
Area of land from Serabai Abraham Penkar through
Power of Attorney holder Sofi Penkar by registered
sale deed dated 28/11/1989.

 As per Mutation entry dated 14/08/1991 it reflects


that, Krushna Rambhau Ramdharne purchased Gala
admeasuring 16.22 [Link] area from Serabai

 As per Mutation entry dated 31/10/1992 it reflects


that, Savita Tukaram Shirsagar purchased First Floor
Gala admeasuring 486 [Link] area from Serabai
Abraham Penkar by registered sale deed dated
20/01/1990.

 As per Mutation entry dated 10/11/2000 it reflects


that, Serabai Abraham Penkar died her legal heirs
namely Mojes Abraham Penkar & Sofi Mojs Penkar
name recorded on the property card.

 As per Mutation entry dated 12/09/2001 it reflects


that, Rajeshkumar Madhubai Patel purchased 34.80
[Link] area from Mojes Abraham Penkar & Sofi Mojes
by registered sale deed dated 16/07/2001.

 After demise of Shrimati Revatibai Baliram Gauri her


legal heirs Vijay Baliram Gauri and Anil Baliram Gauri
names recorded in the property card of the said land.

 As per mutation entry dated 07/09/2013 it reflects


that, CTS.543 A divided into two separate property
card as [Link].543/1/A and [Link].543/2/A and old
[Link].543A closed. [Link].543/1/A is owned by
Suresh Chandmal Jain for 25.06 [Link] Area, Krushna
Rambhau Ramdharne for 16.22 [Link] Area,Savita

area of the said land is owned by Mojes Abraham
Penkar and Sofi Mojes Penkar and [Link].543/2/A is
owned by Vijay Baliram Gauri and Anil Baliram gauri.

 I have taken the search in the respect of the above-
mentioned land in office of the Sub-Register Pen, Tal-
Pen, [Link]. I have gone through the available
records index II, register kept in the office of the Sub-
Registrar Pen for the period of 30 years that is from
1996 to 2025. I do not find some entry regarding
conveyance in respect of the above-mentioned land.

remaining area of the said owned which is by Mojes
Abraham Penkar and Sofi Mojes Penkar is therefore as
under: -

a) The above said Suresh Chandmal Jain is owner of the


25.06 [Link] Area of the [Link].543/A/1, Krushna
Rambhau Ramdharne is the owner of 16.22 [Link] area
of the [Link].343/A/1, Savita Tukaram Shirsagar is the
owner of First Floor Gala admeasuring 486 [Link] area
486 [Link] area of the [Link].343/A/1, Rajeshkumar
Madhubai Patel is owner of 34.80 [Link] Area of the
[Link].343/A/1 and Mojes Abraham Penkar and Sofi
Mojes Penkar are owners of the remaining
[Link].343/A/1 having the absolute and lawful rights
and the got clear and marketable title in respect area of
land bearing [Link].343/A/1 as mentioned above.

b) the Non-Agriculture land is at present free from


encumbrances.
