FOR THE DISPOSAL OF UNSERVICEABLE/ OBSOLETE ARTICLES LYING
UNDER FCI, DIVISIONAL OFFICE KOZHIKODE

Bids are invited online through GeM Portal for the auction of Unserviceable/ Obsolete
articles lying at FCI, Divisional Office Kozhikode, Food Storage Depot (FSD), West Hill,
Thikkodi, Kuttipuram, Meenangadi on “AS IS WHERE IS BASIS”. The bids will be
received online through GeM (Forward Auction) (https://forwardauction.gem.gov.in/eprocure/
home) only and shall be opened as per SOP of GeM.
THE BIDS ARE INVITED LOT WISE. THE ITEMS SHALL BE SOLD TO THE BIDDER WHO
WILL QUOTE THE CONSOLIDATED HIGHEST RATES FOR THE RESPECTIVE LOTS AS PER
THE LIST OF OBSOLETE/ UNSERVICEABLE ITEMS AS DETAILED AT ANNEXURE-I. NO
BID WOULD BE ACCEPTED FOR ANY PART OF THE LOTS.
Desirous companies/bidders may download the tender document from

Detailed list of unserviceable and obsolete articles proposed to be disposed is enclosed


herewith Annexure I.
Eligibility Criteria:
1. The bidder should deposit Rs.10,000/-(Rupees Ten thousand only) as EMD/Bid
Security in the form of NEFT/RTGS/ECS drawn in favour of The Divisional Manager,
FCI, Divisional Office , Kozhikode payable at State Bank of India, Main Branch
Mananchira (A/c No. 10622570298 & IFSC Code -SBIN0000861) for participating in
the auction process before the cut-off date of submission of online Bid through GeM.
EMD of the unsuccessful bidder shall be returned without interest at the earliest on
finalization of the Auction. The bidder has to indicate the requisite details/ transaction
no. (UTR No.) of such payments along with the application for participation in
Auction. The Application/ Bid form (Annexure-II) shall be filled in neatly and
accurately. Any alteration, erasing or overwriting will render the application invalid.

2. Bidders must upload the copy of address proof (Voter ID Card/ Aadhar Card/
Driving License/Passport), PAN Card and GST No. along with bid in the GeM
Portal. Bidder shall have a Registered office in Kerala. In case the uploaded
documents are not readable, the bid cannot be examined, and the bid can be rejected,
thereby rejecting the bid of that firm.
Terms and conditions:
1. The Unserviceable Material/items will be available on Auction "As is where is basis”.
The unserviceable/obsolete articles can be inspected by the interested parties on any
working days between 11.00 Hrs to 16.00 hrs by contacting the respective Offices
under FCI, DO Kozhikode from where the delivery of the same will be made. No
request for inspection after submission of the bid will be accepted.
2. The applicable GST is 18 %, 12% & 5% for disposal of Lots respectively..
3. Food Corporation of India does not guarantee to make any definite quantity and/or any
particular quality of articles available to the buyer.
4. Food Corporation of India reserves the right to accept or reject the highest or any other
bid without assigning any reason or without any legal obligation thereof. The bid shall
remain valid for 45 days after the date of bid opening. If any bidder withdraws his /
her bid before the said period, this office shall without prejudice to any other right or
remedy, be at liberty to forfeit the Bid Security absolutely.
5. Conditional bid shall not be entertained.
6. Evaluation criteria: The successful bidder will be the one who offer the highest total
rate for the unserviceable/obsolete articles as detailed in Annexure I, no part lifting of
the items shall be allowed.
7. All the bidders shall fill the details of EMD column on GeM Portal if the option is
available before submission of bids.
8. The bid without EMD (in original) will be liable for rejection.
9. The undersigned will not entertain any claim for damage done by the way of theft, fire
or any other unforeseen calamity after realizing full payment against the
Unserviceable material/items.
10. The successful bidder after acceptance of his bids will be required to deposit cost

within 07 (seven) working days from the communication of acceptance. The


Unserviceable Material/ items is to be lifted within 10 days on the issue of Release
Order on making full payment in the form in the form of NEFT/RTGS/ECS drawn in
favour of The Divisional Manager, FCI, Divisional Office Kozhikode payable at State
Bank of India, Main Branch Mananchira (A/c No.10622570298 & IFSC Code-
SBIN0000861) Otherwise, the EMD money deposited will stand forfeited.
11. In the event of failure from the part of any successful bidder to complete the payment
within the specified time as being communicated from this office, then the sale
relating to such items shall be cancelled and the earnest money in full shall be
forfeited and re- sale stock at the risk and cost of the original buyer and to recover the
losses suffer by the Corporation as a result of such failure. Any saving of profit on
resale as aforesaid shall exclusively go to the account of the Corporation.
12. At the time of giving delivery if there is a shortage on the declared quantity,
proportionate refund to the buyer will be allowed on presentation of duly supported
bills, in the prescribed form. If any excess quantity is found, proportionate additional
payment shall be made by the buyer in the same manner as referred to above, within
seven days from the date of intimation to this effect by the Divisional Manager, Food
Corporation of India, Divisional Office, Kozhikode.
13. After the balance money including the taxes is deposited by the successful bidder, the
delivery of the stocks will be given by Food Corporation of India. The Goods sold will
be removed by the buyer from the site within the period specified in the
Release/Delivery Order issued. Delivery would be given only during the normal
working hours on all working days on presentation of the copy of the sale Release /
Delivery Order issued by the Divisional Manager, Food Corporation of India,
Kozhikode by the purchaser/Buyer to the stock holder. The purchaser/buyer will make
his own arrangements for loading / transportation and they will not be entitled to claim
any facilities or assistance for the loading / transportation from Food Corporation of
India. In case original buyer wishes to take delivery of the stock purchased through a
representative, he must authorize by letter of authority which shall be presented to the
Officer in whose charge the store is held, such officer may in his entire discretion
decline to act on any such authority and it shall in all cases be the obligation of the
buyer to satisfy such Officer that the authority is genuine. Delivery by the proxy will
be at purchasers/buyers sole responsibility and risk and no claim shall whatsoever be if
delivery is affected to a wrong person.
14. The FCI does not guarantee to make any definite quantity and quality of articles
available to the buyer.
15. The lifting of the items shall be done without damaging the premises / roads / drains
etc. The buyer shall compensate the damages, loss, etc., in the event of any occurrence
otherwise.
16. No selection or sorting whatsoever of the goods will be allowed. The entire
unserviceable/obsolete articles should be cleared by getting proper Gate Pass from
respective Officers under Divisional office Kozhikode.
17. The un-serviceable/Obsolete articles are sold "as is where is” basis and they shall be
removed by the buyer with all the faults and not withstanding any error or miss
statement of description, measurement, quality/ quantity, weight, enumeration or
otherwise and without any question on the part of the buyer and no claim shall lie

against the Food Corporation of India, for compensation. The buyer will not be
permitted to select any portion out of the unserviceable/dead stock articles sold to him
nor shall pay allowance be made or claim lie against the Food Corporation of India for
compensation on account of any such faults mis-statement or arrears although the
same may be considerable nature. The buyer should satisfy himself thoroughly as to
what is offered for sale before bidding at any auction and shall be deemed (whether or
not such inspection shall have in fact taken place) to have had noticed of all defects
and faults, whether rendering the goods un-merchantable or otherwise and any errors
and mis-statements as aforesaid which he might have discovered no compensation on
account thereof, nor shall any party to the sale be entitle to claim or recover from the
other any compensation by way of damage or otherwise if the goods are not available
by reasons of not being if the specified place and contracts shall stand cancelled.
18. If the stocks sold are not moved within the time specified or delivery is not taken at the
time as per the date given in the release order, Food Corporation of India may release
the stocks at the buyer's risk and cost. The buyer shall also be liable to pay storage
charge at l% of total value of all the Unserviceable/ Obsolete articles quoted by the
successful bidder per week from the date following the last date of the free period or
delivery given in the release order, till the date of lifting (inclusive). Any gain in any
resale as aforesaid shall belong to Food Corporation of India without prejudice to the
right to the other reliefs.
19. The buyer shall not subject, transfer or assign the contract or any part thereof without
the prior consent of Food Corporation of India.
20. The materials being disposed is to be treated in line with applicable rules/
notifications/ guidelines etc. as may be prescribed by the Government. The successful
bidder shall be responsible to ensure this action.
21. At any time FCI Divisional Office Kozhikode may modify the bidding document by
amendment thereto. The amendment will be notified on FCI website/GeM only, which
will be binding on bidders. Bidders should regularly visit the website
https://fci.gov.inand keep themselves updated.
22. Tenders not complying with the above conditions are liable to be rejected.
23. The Divisional Manager, FCI Divisional Office Kozhikode reserves the right to accept
or reject any or all the bids received without assigning any reason thereof.
24. All disputes including court proceeding shall be settled within the Kozhikode
Jurisdiction only.
