LAST WILL AND TESTAMENT
I. DECLARATION
I, Dinesh Shah, son of [Father's Name], aged [Age] years, residing at [Full
Address], do hereby make, publish, and declare this to be my Last Will and
Testament, in the exercise of my free will and being of sound and disposing
mind and memory. I hereby revoke any and all former Wills, Codicils, and
testamentary dispositions heretofore made by me.
I declare that I am writing this will out of my free volition and without any
coercion or undue influence whatsoever.
This Will is made on this 7th day of March, 2025 at Mumbai, Maharashtra.
II. APPOINTMENT OF EXECUTOR
1. I hereby appoint my eldest son, [Full Name of Eldest Son],
residing at [Address of Eldest Son], to be the sole Executor of
this Will.
2. In the event that my said son, [Full Name of Eldest Son],
predeceases me, is unwilling to act, or becomes incapable of
acting as the Executor, then I appoint my second son, [Full
Name of Second Son], residing at [Address of Second Son], to
be the Executor of this Will.
3. Any liability, owed by me, and the executor fees and probation
expenses shall be paid from by bank account no………….. (Name
and address of the bank)……… in case, the fund is insufficient
then the income from the property located at ………………..

any surplus amount, then the surplus amount should be
transferred to the savings account of my Wife having bank
account No. ________ in Bank ________.
4. I grant unto my Executor all powers necessary to administer my
estate, including but not limited to, the power to sell, lease,
mortgage, or otherwise dispose of any of my property, whether
movable or immovable, without any order of the court, for the
purpose of paying my debts and/or distributing the assets of my
estate.
III. FAMILY DETAILS
My immediate family members, who are the beneficiaries of this Will, are:
1. Wife: Mrs. Nalini Shah, aged [Age], residing with me.
2. Eldest Son: Mr. Nayan Shah, aged [Age], residing at [Address].
3. Second Son: Mr. Bhuvan Shah, aged [Age], residing at [Address].
4. Youngest Son: Mr. Pancham Shah, aged [Age], residing at

IV. DEBTS AND EXPENSES
I direct my Executor to first pay out of my estate all my just debts, funeral
expenses, testamentary expenses, and any taxes that may be due from my
estate.
V. SCHEDULE OF PROPERTIES
For the purpose of clarity, I have listed my major assets in Schedule-I and II.
This list is not exhaustive, and this Will shall govern the distribution of all
assets owned by me at the time of my death, whether or not they are listed
herein.
VI. SPECIFIC BEQUEST TO MY WIFE
I hereby give, devise, and bequeath, absolutely and forever, all sums of
money, including principal and accrued interest, that are held in my name,
either solely or jointly, in any and all bank accounts. This includes, but is
not limited to, all Savings Accounts, Current Accounts, Fixed Deposits (FDs),
and Recurring Deposits (RDs) held with any bank or financial institution in
India or abroad.
For the avoidance of doubt, the entire proceeds from the following
accounts (and any other accounts not listed but held by me) shall pass
exclusively to my beloved wife, Mrs. Nalini Shah:

This bequest is specific and is to be satisfied before the division of the rest
of my estate. My Executor shall take all necessary steps to transfer the titles
and proceeds of these accounts to my wife as soon as practicable after my
demise.
VII. DISTRIBUTION OF RESIDUARY ESTATE
I hereby direct that all the rest and residue of my estate, including all my
movable and immovable properties as described in Schedule
'A' and Schedule 'B' above, and any other asset I may die possessed of
(excluding the bank balances specifically bequeathed to my wife), shall be
divided into FOUR (4) equal shares.
I give, devise, and bequeath these shares as follows:
1. One-fourth (1/4th) share to my beloved wife, Mrs. [Wife's
Full Name].
2. One-fourth (1/4th) share to my eldest son, Mr. [Full Name of
Eldest Son].
3. One-fourth (1/4th) share to my second son, Mr. [Full Name of
Second Son].
4. One-fourth (1/4th) share to my youngest son, Mr. [Full Name
of Youngest Son].
If any of the above-named beneficiaries predecease me, then the share of
such deceased beneficiary shall devolve upon their legal heirs in
accordance with the law.
VIII. MISCELLANEOUS PROVISIONS
1. No Contest Clause: Should any beneficiary under this Will
contest its validity or the distributions set forth herein, then the
share of such contesting beneficiary shall be forfeited and shall
be distributed equally among the non-contesting beneficiaries
named in Clause VII.
2. Severability: If any provision of this Will is held to be invalid or
unenforceable, the remaining provisions shall continue to be in
full force and effect.
3. Governing Law: This Will shall be governed and construed in
accordance with the laws of the Republic of India.
IX. ATTESTATION
IN WITNESS WHEREOF, I have set my hand to this, my Last Will and
Testament, on the date first above written, in the presence of the two
undersigned witnesses, who have both signed in my presence and in the
presence of each other.
